DoneByHour Terms of Service (TOS)

1. General Terms

By accessing or using DoneByHour services, you agree to comply with and be bound by these Terms of Service (TOS). These terms govern your use of our platform, whether you are a customer purchasing services or a freelancer/expert providing services.

Definitions:

  • “Platform” refers to DoneByHour’s website and services.
  • “User” refers to both customers and freelancers/gig workers unless specified otherwise.
  • “Client” or “Customer” refers to the individual or entity purchasing services.
  • “Freelancer” or “Expert” refers to gig workers or professionals providing services through DoneByHour.

TERMS FOR FREELANCERS, EXPERTS, AND GIG WORKERS

2. Freelancer Responsibilities

As a verified freelancer or expert working with DoneByHour, you are expected to:

  • Provide High-Quality Services: Deliver premium quality work in line with the scope and deadlines agreed upon with the client.
  • Professional Conduct: Maintain professional communication with clients and DoneByHour team members. Always treat confidential information and client details with care.
  • Confidentiality: You must protect any confidential information you access during the project. Disclosure or misuse of client or DoneByHour’s sensitive information will result in immediate termination of your agreement and possible legal action.

3. Payment and Compensation

  • Project-Based Compensation: You will be paid based on the specific projects you work on, according to the agreed rates. Payment will be released once the project has been successfully completed and approved by the client.
  • Payment Terms: Payments will be made to your provided account within 14 days after final project approval, subject to our verification process.
  • Dispute Resolution: If any disputes arise regarding project completion, quality, or payment, they must be addressed through DoneByHour’s internal dispute resolution process.

4. Intellectual Property Rights

  • Ownership of Deliverables: All work products and deliverables provided during the course of a project will become the intellectual property of the client upon completion and full payment. You waive any rights to further compensation from the use of those deliverables by the client.

5. Non-Compete and Conflicts of Interest

  • Non-Compete Clause: Freelancers may not directly contact or enter into separate agreements with DoneByHour clients for work outside of the DoneByHour platform during or within 6 months after completion of the last project.

6. Termination

  • Termination of Contract: DoneByHour reserves the right to terminate your contract if you fail to meet the quality standards, deadlines, or violate confidentiality agreements.

7. Limitation of Liability

DoneByHour will not be liable for any indirect, incidental, or consequential damages arising from the use of services provided through the platform.

8. Changes to the Terms

DoneByHour reserves the right to modify these terms at any time. Users will be notified of significant changes via email or through the platform.

9. Governing Law

These terms are governed by the laws of the Republic of Estonia. Any disputes arising under these terms will be subject to the exclusive jurisdiction of the courts in the Republic of Estonia.

10. Ownership and Portfolio Restrictions for Freelancers

  • Work Ownership: Any work completed by freelancers, gig workers, or verified experts for DoneByHour is owned by DoneByHour and/or the client who commissioned the work. Freelancers do not retain any rights to the work once completed and delivered.

  • Portfolio Restrictions: Freelancers and gig workers are prohibited from using any work completed for DoneByHour clients in their personal portfolios, websites, or for any marketing purposes, as the work is commissioned under DoneByHour’s name and branding. Any unauthorized use of client work may result in termination of the contract and possible legal action.

Confidentiality and Consequences of Violation

Violation of confidentiality by either freelancers or clients may result in immediate termination of access to DoneByHour’s services and legal action. DoneByHour reserves the right to seek damages for any loss incurred due to such violations.
