1. General Terms

By accessing or using DoneByHour services, you agree to comply with and be bound by these Terms of Service (TOS). These terms govern your use of our platform, whether you are a customer purchasing services or a freelancer/expert providing services.

Definitions:

• “Platform” refers to DoneByHour’s website and services.
• “User” refers to both customers and freelancers/gig workers unless specified otherwise.
• “Client” or “Customer” refers to the individual or entity purchasing services.
• “Freelancer” or “Expert” refers to gig workers or professionals providing services through DoneByHour.

TERMS FOR CUSTOMERS AND CLIENTS

2. Service Terms

By purchasing services from DoneByHour, you agree to the following:

• Scope of Services: DoneByHour provides premium project-based services, including but not limited to video editing, logo design, and social media management. The full scope of each service will be defined in individual agreements made with clients.
• Customization: Clients can request revisions within the agreed-upon number of revisions. Additional work beyond the scope may incur extra fees.

3. Payment Terms

• Pricing: All services are charged based on project specifications. The pricing will be agreed upon before the project begins.
• Payment Method: Payment must be made through the platform using approved methods (e.g., credit card, Stripe, etc.). Work will not commence until the agreed deposit or full payment has been made.
• Refunds: Due to the custom nature of our services, refunds are generally not provided. However, if the service delivered does not match the agreed-upon scope, you may be eligible for partial refunds or revisions.

4. Confidentiality and Data Protection

• Confidentiality: DoneByHour will take every reasonable measure to protect the confidentiality of your information. All freelancers are bound by a confidentiality agreement to ensure your data remains secure.

5. Intellectual Property

• Ownership of Work: Upon full payment, all intellectual property rights to deliverables (e.g., logo designs, videos) are transferred to you. You may use them freely for your personal or business purposes.

6. Revision Policy

• Included Revisions: Services may include a limited number of revisions (e.g., 2-3). Additional revisions may require extra fees.
• Time Frame for Revisions: Revisions must be requested within 3 days of delivery. Requests beyond this period will be considered a new service and charged accordingly.

7. Dispute Resolution

• Resolution Process: In the event of dissatisfaction with a service, both clients and freelancers agree to first attempt resolution through DoneByHour’s dispute management system before pursuing external remedies. This ensures fair handling of complaints and minimizes disputes.

8. Limitation of Liability

DoneByHour will not be liable for any indirect, incidental, or consequential damages arising from the use of services provided through the platform.

9. Changes to the Terms

DoneByHour reserves the right to modify these terms at any time. Users will be notified of significant changes via email or through the platform.

10. Governing Law

These terms are governed by the laws of the Republic of Estonia. Any disputes arising under these terms will be subject to the exclusive jurisdiction of the courts in the Republic of Estonia.

11. Portfolio and Marketing Rights

• Use of Work for Portfolio: By purchasing services from DoneByHour, you grant us the right to showcase a preview of the work we have done for you (e.g., video edits, logo designs) in our portfolio, marketing materials, and on our website. This is important for building our reputation and demonstrating the quality of our services to potential clients.

• Opt-Out Policy: If you prefer that your work not be used for these purposes, you may request removal at any time by contacting DoneByHour’s support team. Upon receiving such a request, we will remove your work from our portfolio and any marketing materials immediately.

Confidentiality and Consequences of Violation

Violation of confidentiality by either freelancers or clients may result in immediate termination of access to DoneByHour’s services and legal action. DoneByHour reserves the right to seek damages for any loss incurred due to such violations.
